Digitate Acceptable Use Policy
Digitate is dedicated to providing useful and valuable services, software, software-as-a-service, service-as-a-software, and more (“Offerings”) to its users. We view it as a great privilege to support our users who entrust us with their material. For the protection of our overall user community and compliance with applicable laws and regulations, we reserve the right to act on content or material that violates this Acceptable Use Policy. Such action can include content removal, account discipline, or account suspension/termination.
Please adhere to the following when using the Digitate Offerings.
1. Copyright, patent, trademark, and trade secret. Do not upload or distribute content on Digitate’s Offerings that you do not have a right to transmit under any law, including copyright, patent, trademark, and trade secret law, or that you do not have a right to transmit under contractual or fiduciary relationships, or content that infringes the above-mentioned intellectual property rights.
Copyright is a form of legal protection for original works of authorship, such as books, movies, photos, music, and software code. Copyright law prohibits others from copying or displaying another’s work without permission, subject to a few exceptions, most commonly “fair use.” “Fair use” is, in most circumstances, an application of another’s work for criticism, comment, news reporting, teaching, scholarship, research, etc.
Patents are a form of legal protection that secure innovations which are new and useful. Once awarded, a patent grant permits the holder to prevent others from making, using, selling, offering to sell, or importing goods that are covered by the patent.
A trademark is a word, logo, phrase, or design that distinguishes a trademark owner’s goods or services in the marketplace. Trademark law prevents someone from using a trademark to confuse others about whether a product or service is authentic, or to suggest that there is a relationship with the trademark owner when there is not.
A trade secret is confidential information held by a business that is valuable to the business and not known to others, and by virtue of its being secret provides the business a competitive advantage. Examples of a trade secret include a formula, program, device, method, technique, process, etc.
2. Private Information. You may not provide Digitate’s Offerings with other people’s private information without their express permission. Private information can include home address or physical location information, such as street address, GPS coordinates or other identifying information related to locations that are considered private; identity documents, including government-issued IDs and social security or other national identity numbers; contact information, including non-public personal phone numbers or email addresses; financial account information, including bank account and credit card details; and other private information, such as biometric data or medical records.
3. Privacy. Do not use Digitate’s Offerings to surreptitiously record the communications of others or to identify or verify individual identities based on media containing people’s faces or other physical, physiological, or behavioral characteristics, or for ongoing surveillance or identification or persistent tracking of an individual using any of their personal information; to impersonate another person, or to create obligations under the Health Insurance Portability and Accountability Act, as amended (“HIPAA”) or any similar health/medical privacy regulation.
4. Hateful content. Refrain from using Digitate’s Offerings to advance content that attacks, marginalizes, or dehumanizes a group of people or an individual because of their race, religion, disability, ethnicity, disease, sex, gender, gender identity, sexual orientation, financial means, immigration status, or political party affiliation. This includes but is not limited to using slurs, epithets, tropes, conspiracy theories, or misinformation. This also includes content that contains name-calling, abusive insults, bullying, harassing, stalking, trolling, or is considered likely to disrupt, provoke, or attack others, or content that threatens or glorifies violence.
5. Objectionable content. Refrain from providing Digitate’s Offerings with content that is pornographic, sexually explicit, obscene, or contains nudity, content that is vulgar, utilizes profanity, or is otherwise offensive, or content that is violent or cruel, content that contains graphically violent, abusive, or gory images, content that promotes or glorifies self-mutilation, eating disorders, physical abuse, or drug abuse; or content that describes, features, or promotes terrorism or violence; or content that threatens the unity, integrity, defense, security or sovereignty of any country, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence.
6. Unethical and Illegal use/content. Refrain from using Digitate’s Offerings to advance content that intends to deceive or cause harm, condones or encourages unlawful activity, content that involves defamation or contempt of court, content that depicts or promotes unwanted sexual contact or touching, content that promotes illegal drugs, firearms, or explosives, or content that advocates prostitution or escort services; use or advance content that deceives or misleads about the origin of the content/message or knowingly communicates information that is patently false or misleading in nature but may reasonably be perceived as fact; or advance content that is purposefully manipulative or deceptive or employ techniques designed to distort the behavior of a person by impairing their ability to make an informed decision; or content that is harmful to children or calculated to interact with individuals under the age of consent in any way that could result in exploitation or manipulation, child sexual exploitation or abuse; or content that is otherwise prohibited by law or regulation; or use for social scoring or predictive profiling that would lead to discriminatory, unfair, biased, detrimental, unfavorable, or harmful treatment of certain persons or groups of persons; or categorize people based on their characteristics or affiliations such as race, political opinions, trade union membership, religious or philosophical beliefs, sex life or sexual orientation; or to infer people’s sensitive attributes such as gender, race, nationality, religion, or specific age; or to infer people’s emotional states from their physical, physiological, or behavioral characteristics.
7. Misuse of GenAI. Do not use the generative AI (“GenAI”) features of Digitate’s Offerings to generate content with the purpose of removing or altering content credentials or other provenance methods, marks, or signals (“AI Content Credentials”) that indicate that the content was AI generated content; or to detect AI Content Credentials with the purpose of removing or altering them, or to generate undesired output content due to the limitations of GenAI or scenarios in which the system cannot be applied in a way that properly manages potential negative consequences to people and society or infringe the intellectual property rights or proprietary rights of any person/entity; or to discover any underlying components of the models, algorithms, and systems, such as exfiltrating the weights of models; or conduct web/data scraping, web/data harvesting, or other data extraction methods to extract data from any APIs or GenAI models, except as necessary to enable an intended usage scenario for the SaaS Services.
Only use Digitate’s Offerings for lawful, proper, and appropriate purposes.
