You have reached the Digitate privacy addendum for United States. To go back to the general Digitate privacy notice, please click here.

For residents of the United States, when we collect and use personal information about you, we may be subject to data protection, security or privacy related laws, including but not limited to the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act (“VCDPA”) (“Data Privacy Laws”). We may be responsible as a “business” or “controller” for such personal information. Below you will find the additional specific provisions which may be applicable to you as a resident of the United States, including your rights to your data as it may be processed by TCS. 

Personal Information We Collect:

We collected the following categories of personal information in the preceding 12 months as indicated with a checkmark below:

Identifiers such as real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol address (“IP address”), email address, account name, social security numbers, driver’s license numbers and other similar identifiers

Inferences drawn from any of the personal information listed above to create a profile or summary about, for example, and individual’s preferences and characteristics

We collect this personal information from you and from other categories of sources, including web servers and affiliates who provide analytics and performance enhancement services, third-party event organizers, social networks, service providers, and partners with which we offer co-branded services or engage in joint marketing activities.

TCS has disclosed personal information to the following categories of third-parties: our affiliates, service-providers, suppliers, and government authorities.  

TCS does not use or disclose sensitive personal information for purposes other than those permitted under the California Civil Code. 

TCS does not sell or share the personal information of consumers under 16 years of age. 

Your Rights In Connection With Personal Data

Based on your state of residency, you may have the right to the following: 

  • Request access to your personal information. This enables you to confirm whether we are processing your personal data and to receive a copy of the personal information we hold about you. 
  • Request erasure of your personal information. This enables you to ask us, in certain situations, to delete or remove sensitive personal data unless our processing is specifically permitted under the Data Privacy Laws. 
  • Right to correct inaccurate personal information that a business maintains about you. 
  • Right of disclosure for sale of personal information or use for business purpose. This enables you ask us, in certain circumstances, to provide you with the categories of personal information and third parties we disclose to for sale or business purposes. As TCS does not sell your personal information under any circumstances, this right may only apply where TCS discloses your personal information for a business purpose.  
  • Data portability. This enables you to ask us, in certain circumstances, to provide you with the personal information you have provided to us in a structured, commonly used and machine-readable format or to transmit the personal information that you have provided to us to another party. 
  • Right to opt-out. This enables you to opt-out of the processing of personal information for the purposes of (i) targeted advertising, (ii) the sale of personal information, or (iii) profiling in furtherance of decisions that significantly impact you. TCS does not sell your personal information under any circumstances. 

Our use of online tracking technologies may be considered a “sale” or “sharing” as those terms are defined under certain Data Privacy Laws. To that extent, you can opt out of these online tracking technologies by submitting a request to US.Privacy@tcs.com, or by broadcasting an opt-out preference signal such as the Global Privacy Control. Please note that some features of our website may not be available to you as a result of these choices. 

  • Right to non-discrimination: This specifies that TCS will not discriminate against you in any way or under any circumstance for exercising your rights to your sensitive data under Data Privacy Laws.  

If you are a United States resident, or are an authorized agent of a United States resident, and want to exercise one of the above-rights in connection with your personal information, please contact our US Privacy Officer @ US.Privacy@tcs.com. What we may need from you: 

If you exercise one of the above rights, we may need to request specific information from you to help us confirm your identity and that you are entitled to make such a request. This is to ensure that personal data is not disclosed to any person who has no right to receive it.  

You may use an authorized agent to submit a consumer request on your behalf. If you use an authorized agent, we will require (i) proof of written permission for the authorized agent to make requests on your behalf, and identity verification from you; or (ii) valid proof of power of attorney. We may deny a request from an authorized agent that does not submit sufficient documentation. 

Appeals: 

You have the right to appeal our denial of any request that you or your agent submits in connection with the rights outlined above. To exercise this right, you may submit your request to US.Privacy@tcs.com and include the word “APPEAL” in the subject line. We will then inform you of any action taken or not taken in response to your appeal, including an explanation of the reason for the decision, and information regarding any additional recourse if applicable.
